Notice on Rectification of Typical Problems Found in

In order to further strengthen the supervision of power market access, give full play to the role of licenses in ensuring the safety of power construction and standardizing the order of the power market, according to the regulations on power supply and use, regulations on power supervision, measures for the administration of licenses for installation (repair and trial) of power facilities, from September to December 2016, the National Energy Administration has carried out special supervision work (hereinafter referred to as "special supervision work") in 14 provinces (autonomous regions and municipalities) across the country on the implementation of the installation (repair and test) power facilities licensing system for distribution network construction and renovation projects. We hereby report the typical problems found in the power grid and power facilities enterprises that are installed (repaired and tested) in this special supervision work. All power enterprises are requested to attach great importance to them and strictly implement the relevant rectification work requirements.
Notification of Typical 1. Issues
(I) Power Grid Enterprise
1. State Grid Jibei Electric Power Co., Ltd. Zhangjiakou Power Supply Company and State Grid Hebei Electric Power Company Xingtai Power Supply Company did not implement the special supervision requirements in place, and the self-examination work was not serious, especially for the illegal labor subcontracting of their affiliated multi-economic (collective) enterprises. There are loopholes in the supervision and management of problems such as unlicensed operations of construction personnel;
2. Fengtai Power Supply Company of Anhui Electric Power Company of the State Grid is not strict in the requirements and examination of the licensing qualification of power facilities for installation (repair and test) in the contracting process, and contracts out the construction and renovation project of distribution network to construction enterprises that do not have the corresponding licensing qualification for installation (repair and test) of power facilities;
3. State Grid Ningxia Electric Power Company in the distribution network construction and transformation project bidding link in an unreasonable way to raise the market access threshold, restricting potential bidders. For example, some of its bidding 35kV and below distribution network construction and transformation projects require bidding enterprises to hold a three-level and above installation (repair, test) power facilities license;
4. For distribution network construction and renovation projects in some provinces such as Jilin and Sichuan, the final bid-winning construction unit in the contracting link is basically a multi-economic or collective installation (repair and test) enterprise that is related to the power grid company system. Construction enterprises outside the power grid company system, especially private installation (repair and test) enterprises, are basically unable to win the bid in the project contracting link.
(II) installation (repair, test) power facilities enterprises
1. China Energy Construction Group Anhui Electric Power Construction First Engineering Co., Ltd. and other three undertaking (repair, trial) power facilities enterprises have subcontracting and illegal subcontracting in the distribution network construction and renovation project.
two.. Guangxi Yitong Construction Engineering Co., Ltd., Hunan Xiangxiang Electric Power Construction Co., Ltd. and other three installation (repair and test) enterprises lease or lend to individuals the installation (repair and test) power facilities license (hereinafter referred to as "license").
3. Anhui Yongshen Electric Power Engineering Co., Ltd. and other five enterprises undertaking (repair and test) projects beyond the license level or category.
4. Shanxi Yangquan suburban electrical installation company and other 4 undertaking (repair, test) power facilities enterprises altered license contracting project.
2. rectification work requirements
(I), in response to the typical problems reported in this report, all power companies should draw inferences from one another, carefully sort out and investigate similar problems within the company's system, and further strengthen the implementation of the requirements of the licensing system for the installation (repair and test) of power facilities. Power grid enterprises should also focus on further breaking the "invisible" barriers in the market, ensure the right of all kinds of market operators (especially private installation (repair and test) power facilities enterprises outside the power grid system) to participate in the market competition of power grid engineering construction on an equal footing, and study and put forward specific measures to effectively maintain a fair competition environment in the market.
(II) According to the relevant provisions of the Notice of the National Energy Administration on Further Doing a Good Job in Licensing Management of Power Facilities for Installation (Repair and Test) (National Energy Qualification [2016] No. 352), the 15 installation (repair and test) power facilities enterprises involved in the typical problem notification (see annex for details) that violate the license management system have been included in the blacklist of installation (repair and test) power facilities enterprises in 2017 (hereinafter referred to as "blacklist"). All electric power enterprises are requested to strictly strengthen the examination of the licensing qualifications of blacklisted enterprises in the process of project bidding; for power grid projects under construction that have already been blacklisted enterprises participating in construction activities, on-site inspection should be carried out immediately, and relevant construction enterprises should be required to stop work for rectification if problems and hidden dangers are found.
The (III) requests all electric power enterprises to form detailed written materials on the implementation of the above two rectification work and submit them to the State Energy Administration before April 20, 2017. If it is not submitted within the time limit, the National Energy Administration will deal with it in accordance with the relevant provisions of the Electricity Regulatory Regulations.
