Notice on Implementing the Document No. 140 [2015] of Building a City and Promoting the Unified Opening of the Construction Market
Municipal Housing and Urban-Rural Construction Committee (Construction Bureau), relevant municipal urban management and garden bureaus:
In order to implement the relevant requirements of the Ministry of Housing and Construction on the issuance of a number of provisions on promoting the unified opening of the construction market (Jianshi [2015] No. 140) and promote fair competition among construction enterprises, the following requirements are hereby put forward for promoting the unified opening of the construction market and standardizing the supervision of cross-regional contracting business services of construction enterprises. Please implement them conscientiously.
1. standardize the relevant services and supervision of construction enterprises (referring to independent legal entities that have obtained qualification certificates for engineering survey, design, construction, supervision, bidding agency, cost consultation, engineering quality inspection, etc.) entering Shandong across provinces and undertaking business across regions in Shandong Province, adhere to the principle of streamlining administration and delegating powers and facilitating enterprises, simplify pre-management, strengthen supervision during and after the event, and give the same treatment as local construction enterprises, accelerate the unified opening of the construction market.
2. construction enterprises from outside the province to enter Shandong to undertake business, cancel all kinds of filing and examination systems for entering Shandong and entering the market that do not conform to the provisions of document No. 140, and submit the basic information of enterprises to the Provincial Department of housing and urban rural development through the integration platform of construction market supervision and integrity information of Shandong Province (hereinafter referred to as "provincial integration platform").
3. construction enterprises outside the province to submit basic information through the provincial integration platform, merged into the provincial housing and construction department "on the start of the province's construction market supervision and integrity information integration platform trial operation notice" (Lu Jianjian word [2015] No. 32) required user registration verification link. Enterprises fill in basic information online, scan and upload relevant materials, and verify relevant licenses at the housing and construction departments of districts and cities, the first stop to enter Shandong to contract business. If the basic information of the enterprise changes, the information shall be changed through the provincial integrated platform in a timely manner, and the nearest district and city housing construction department where the business is contracted shall be verified.
4. construction enterprises outside the province submit information and verify it through the provincial integrated platform, the provincial housing and construction department will uniformly push it to the housing and construction departments of districts, cities, counties (cities, districts) and publicize it to the public. Enterprises can undertake business within the province, and housing construction departments at all levels shall not require enterprises to submit information twice.
5. construction enterprises in the province to undertake business across regions within the province, where basic information has been submitted through the provincial integration platform registration verification, housing and construction departments at all levels shall not require enterprises to submit information repeatedly.
The housing and construction departments of all districts, cities and counties (cities, districts) of the 6. shall, in accordance with the principle of "who issues, who cleans up", comprehensively clean up the regulations on the supervision and management of cross-regional contracting business of construction enterprises in their administrative areas, and shall not violate laws and regulations. According to the provisions of the Ministry of Housing and Urban-Rural Development, the 9 behaviors prohibited by Article 8 of the "Notice on Promoting the Unified Opening of the Construction Market. It is necessary to conscientiously do a good job in the management of project contract filing, strengthen the "two linkage" between the market and the site, timely grasp the construction behavior of enterprises in engineering projects, and do a good job of supervision and management in accordance with laws and regulations.
7. smooth the service and supervision and coordination channels for construction enterprises to contract business across regions. For foreign construction enterprises that have committed serious violations of laws and regulations or practiced fraud when submitting basic information of enterprises, the housing and construction department of the project site shall promptly notify the housing and construction department of the place where the enterprise is registered. Relevant issues involving construction companies outside the province shall be reported by the housing construction department of districts and cities to the Provincial Department of Housing and Urban-Rural Development for notification; related issues involving construction companies that contract business across cities in the province, the housing construction department of the company's registration place should actively do a good job in linkage Supervise and deal.
8. the construction enterprises in the province to carry out business in other provinces, their information shall be subject to the information published by the provincial integration platform and uploaded by the Ministry of Housing and Construction, and the Provincial Housing and Construction Department will no longer issue relevant certificates in principle.
9. the provincial housing and construction department to establish an inter-city coordination and linkage mechanism for the unified opening of the construction market, the housing and construction departments of all districts and cities should attach great importance to it, strengthen organizational leadership, supervision and inspection, and clarify the local lead department (office) and liaison officer responsible for the management of cross-regional contracting business of construction enterprises. Please fill in the contact form of inter-city coordination and linkage mechanism (Annex 2) and report to the provincial housing and construction department before March 14.
10. This notice shall come into force on March 15, 2016 and shall be valid for 5 years, opinions on strengthening the filing management of survey and design enterprises outside the province to undertake business in Shandong (Lu Jianshe [2008] No. 26), opinions on the implementation of supervision and management of construction enterprises from other provinces to undertake business in Shandong (Lu Jian Guan xing [2013] No. 6), notice on further strengthening the construction management of enterprises outside the province into Shandong (Lu Jian Guan xing Fa [2006] No. 4), about printing and distributing the notice of Shandong Province on the implementation of the regulations on the qualification management of engineering supervision enterprises (Lu Jianfa [2008] No. 8), the notice on further strengthening the filing management of branches of bidding agencies for construction projects (Lu Jianzhao letter [2012] No. 8), the filing system of cross regional undertaking business of engineering cost consulting enterprises (Lu biao zi [2008] No. 21) and other documents related to construction enterprises cross-provincial and municipal filing management regulations to stop the implementation. Construction enterprises outside the province that have previously registered and verified users on the provincial integration platform need to improve and verify relevant information according to the requirements of this notice before pushing and publicizing.
