National Energy Administration on strengthening power generation enterprise licensing

Notice on matters related to supervision and management

All dispatched energy regulatory agencies, provinces, autonomous regions, municipalities directly under the Central Government, Xinjiang Production and Construction Corps Development and Reform Commission (Energy Bureau), Economic and Information Commission, State Grid Corporation, China Southern Power Grid Corporation, Inner Mongolia Electric Power (Group) Co., Ltd., Huaneng, Datang, Huadian, Guodian, State Power Investment Corporation, Shenhua Group, China Coal Group, China Investment Group, China Resources Group, related power companies:

In order to further implement the relevant requirements of the State Council on streamlining administration and delegating powers, combining decentralization and management, changing functions, and optimizing services, strictly enforce the power business licensing system, speed up the elimination of backward production capacity, promote the development of renewable energy, and give full play to the role of licenses in standardizing the operation behavior of power enterprises, the relevant matters are hereby notified as follows:

1. a strict licensing system and investigate and deal with unlicensed operations

Except for cases expressly exempted by the National Energy Administration, generating units must obtain a power business license before they can be connected to the grid.

The dispatched energy regulatory agencies shall carry out investigation work on the generator sets that are connected to the grid within their respective jurisdictions, and those that have not obtained a permit for grid-connected power generation shall be dealt with seriously.

The (I) shall immediately issue a notice of ordering rectification to the affiliated enterprises of generator sets that have not obtained the license, requiring the relevant enterprises to go through the license formalities with the dispatched energy regulatory agency before December 31, 2016. Units that have not obtained the power business license before June 30, 2017 are not allowed to generate electricity on the Internet, and refuse to implement them, in accordance with the relevant provisions of the regulations on Electric Power Supervision (order No. 432 of the State Council of the People's Republic of China) and the provisions on the Administration of Electric Power Business license (order No. 9 of the State Electric Power Regulatory Commission), it shall be dealt with in accordance with the law.

(II) power grid enterprises that do not implement the relevant requirements and do not cooperate with the relevant regulatory work shall be notified and criticized, and those who refuse to implement shall be dealt with in accordance with the law.

The dispatched energy regulatory agency shall promptly notify the relevant departments of the local government of the situation of the unit that has not obtained the permit.

2. strengthen the supervision of the license of the extended service unit, and clarify the relevant requirements for the continued operation of the generator set.

If the operation of the generator set reaches the design service life, it shall apply to the local energy regulatory agency for retirement, and shall not continue to be connected to the grid for power generation. If the application for retirement is not due, the dispatched energy regulatory agency shall make public announcement and cancel the license according to law.

If the generator set complies with the national industrial policy and energy conservation and emission reduction policy, and is not included in the shutdown or suspension plan of the relevant government departments, if it needs to apply for continued operation, it shall apply to the local energy regulatory agency for continued operation 3 months before the expiration of the design life of the unit. In accordance with the relevant requirements of the "Notice of the National Energy Administration on Printing and Distributing the Interim Provisions on the Transformation, Life Extension and Decommissioning of Sub-critical Coal-fired Power Units" (Guoneng Power [2015] No. 332), coal-fired power units shall provide relevant certification materials for life extension transformation and safety assessment when applying for continued operation, and the dispatched energy regulatory agency shall grant its continued operation in accordance with the time limit specified in the certification materials. If other types of generating units apply for continued operation, they shall also carry out life extension transformation and safety assessment in accordance with relevant national and local regulations, and provide corresponding certification materials.

Departments with safety supervision and management responsibilities should strengthen the safety supervision and management of extended service units.

3. Code-Requirements for grid connection of new generating units

The newly-built generator set must obtain a power business license (power generation type) within three months after the completion of the start-up and trial operation time point. Those who fail to obtain the power business license (power generation type) within the time limit shall not generate power on the Internet, and those who refuse to implement it shall be dealt with by the dispatched energy regulatory agency in accordance with the law.

4. Adjusts Exemption Scope for Small Hydropower Stations

The scope of power generation business exemption for small hydropower stations is adjusted from a single station installed capacity of less than 1MW (excluding) to a single station installed capacity of less than 6MW (excluding). When the relevant enterprises, units or individuals operate the power generation business of small hydropower stations with a single station of less than 6MW (excluding), they are no longer required to obtain a power generation business license.

Matters related to the grid connection procedures and follow-up supervision and management of power generation projects exempted from licenses shall be in accordance with the provisions and requirements of the "Notice of the National Energy Administration on Clarifying Matters Related to the Management of Electric Power Business Licenses" (National Energy Qualification 2014 No. 151) and its supporting related documents Implement.

This notice shall be implemented as of the date of issuance. If the relevant power business license management documents before the issuance of this notice are inconsistent with this notice, this notice shall be implemented.
