The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, all ministries and commissions of the State Council and all institutions directly under the State Council:
On the basis of the full implementation of the "three-in-one" registration system reform of industrial and commercial business licenses, organization code certificates, and tax registration certificates, and then integrate social insurance registration certificates and statistical registration certificates to achieve "five certificates in one, one license and one code" It is an important measure to continue to deepen the reform of the commercial system, optimize the business environment, and promote mass entrepreneurship and innovation. In order to accelerate the promotion of this reform, with the consent of the State Council, the relevant matters are hereby notified as follows:
General 1. requirements
We will implement the deployment requirements of the State Council on deepening the reform of streamlining administration and delegating powers, combining decentralization and management, and optimizing service reforms. We will coordinate and promote them as a whole, organize and implement them carefully, and formally implement the "five certificates in one, one license and one code" from October 1, 2016, so as to realize information sharing and business collaboration on a larger scale and at a deeper level, consolidate and expand the achievements of the "three certificates in one" registration system reform, reduce the institutional cost of entrepreneurial access, optimize the business environment, stimulate the vitality of enterprises, promote mass entrepreneurship and innovation, and promote employment growth and sustained and healthy economic and social development.
The guiding principles for promoting the reform of the registration system of "five certificates in one, one license and one code" are:
-Uniform specifications. Establish, improve and strictly implement standards for enterprise registration and data exchange to ensure seamless connection, smooth operation, openness and fairness of the whole process.
-- Mutual recognition of information sharing. Strengthen the information interconnection between relevant departments, realize the efficient collection, effective collection and full use of enterprise basic information, and let "enterprises run less" with "data network uplink".
-- Process simplification and optimization. Simplify and integrate work links, strengthen departmental coordination and linkage, speed up business process reengineering, and ensure that procedures are simple, management is fine, and time limits are clear.
-Convenient and efficient service. Expand service channels, innovate service methods, and implement full-process electronic registration management and online and offline integrated operation to make enterprises more convenient, faster and more efficient.
2. main tasks
(I) improve the one-stop service mechanism. Based on the working mechanism and technical scheme of "three certificates in one", it should be improved in accordance with the requirements of the reform of the registration system of "five certificates in one, one license and one code. The working mode of "one set of materials, one form of registration and one window of acceptance" is fully implemented. When applying for enterprise registration, applicants only need to fill in "one form" and submit "one set of materials" to "one window". The registration department directly issues a business license loaded with a unified social credit code, and the relevant information is publicized in the national enterprise credit information publicity system and collected to the national credit information sharing platform. Enterprises will no longer handle separate social insurance registration certificates and statistical registration certificates. Actively promote the whole process of electronic registration management of "five certificates in one" application, acceptance, review, approval, license issuance, and publicity, and accelerate the realization of "five certificates in one" online processing.
(II) promote inter-departmental information sharing and mutual recognition. Formulate unified information standards and transmission plans, transform and upgrade relevant business information systems and sharing platforms, improve information sharing mechanisms, and do a good job in data import, sorting and conversion, so as to ensure that data information falls to the working window and is effectively integrated and used in business systems of relevant departments. The registration authority shall transmit the basic registration information, change and cancellation information of the enterprise to the information sharing platform in a timely manner; if the conditions for online sharing are not available for the time being, the registration authority shall provide the above information within a limited time. If the enterprise registration information cannot meet the needs of social insurance and statistical work, the social insurance agency and statistical agency shall supplement the collection when carrying out their respective business work. After the social insurance agency handles the social insurance registration for its employees by the employer, the statistical agency shall promptly feed back the relevant basic information related to the enterprise to the information sharing platform in accordance with the law after completing the statistical investigation task. Improve the inter-departmental information inquiry and verification system.
(III) do a good job of registration mode conversion and convergence. Enterprises that have obtained a business license loaded with a unified social credit code in accordance with the "three certificates in one" registration model do not need to re-apply for the "five certificates in one" registration, and the registration authority will send the relevant registration information to social insurance agencies and statistics Institutions and other units. If the original license of an enterprise expires, applies for change registration or applies for renewal of a business license, the registration authority shall issue a business license loaded with a unified social credit code. The system of regular verification and replacement of social insurance registration certificates and statistical registration certificates shall be abolished, and enterprises shall submit annual reports to the industrial and commercial departments and publicize them to the public in accordance with the provisions. The annual reports shall be open and shared to social insurance agencies, statistical institutions and other units through the national enterprise credit information publicity system. The places where the statistical registration certificate has not been issued or has been canceled shall be connected by means of information sharing with statistical institutions.
(IV) promote the "five certificates in one, one according to one code" business license widely used. After the reform, enterprises that were originally required to use social insurance registration certificates and statistical registration certificates to handle related businesses will all be changed to use business licenses. Government departments at all levels, enterprises and institutions, and intermediary agencies must be recognized, and enterprises must not be required to provide other For identification materials, the competent departments of various industries must strengthen guidance and supervision. Actively promote the application of electronic business license.
(V) strengthen the capacity building of the service window. Focusing on the laws and regulations, technical standards, business processes, document specifications, information transmission, etc. involved in the reform of the registration system of "five certificates in one, one license and one code", the system strengthens business training, so that the staff of the service window can accurately grasp the reform requirements, master the business process and work norms, and improve service efficiency. Speed up the standardization and standardization of service window services, highlight the problem orientation, further improve the window service function, and truly realize a window to the outside world and one-stop settlement. Strengthen the staff strength and performance appraisal of the office window. Improve the administrative relative evaluation system, and continuously improve the window service capacity.
3. work measures
(I) strengthen organizational leadership. All relevant departments and local governments at all levels should attach great importance to the reform work in a down-to-earth manner in accordance with the division of tasks and schedule. The main leaders should personally grasp and coordinate in a timely manner to solve the problems encountered in the reform. Problems such as inadequate implementation and unsmooth connection in the reform of the "three certificates in one" registration system should be carefully studied and solved together in the reform of the "five certificates in one, one license and one code" registration system. Departments of industry and commerce, human resources and social security, statistics, institutional establishment, development and reform, and the legal system should each take their own responsibilities and cooperate to ensure the smooth progress of the reform. The laws, regulations, rules and normative documents involved in the reform shall be revised and improved in a timely manner in accordance with the procedures.
(II) strengthen supervision and inspection. Relevant departments should organize joint supervision and conduct targeted supervision and inspection of the progress of the reform. The State Council shall organize special supervision and inspection in due course. Smooth social supervision channels. Praise and encourage those who are proactive and effective in their work, and be seriously accountable for ineffective implementation and delays in the reform process.
(III) strengthen publicity and guidance. Relevant departments should conduct a comprehensive and accurate interpretation of the reform policy, promote effective experience and practices, and promptly answer and respond to relevant hot and difficult issues, so that enterprises and the public can fully understand the reform policy, and form a good atmosphere for promoting the implementation of reforms.
New situations and problems encountered by all regions and departments in the process of promoting reform should be reported to the State Council in a timely manner.
