The Ministry of Housing and Urban-Rural Development has notified the Ministry of Finance that it is required to do a good job in cleaning up and standardizing deposits in the field of engineering construction.
In order to implement the spirit of the notice of the general office of the State Council on cleaning up and standardizing the deposit in the field of engineering construction, effectively reduce the burden of enterprises, reduce the institutional transaction costs, and create a good environment for the development of enterprises, the Ministry of housing and urban rural development and the Ministry of Finance jointly issued a notice recently, requiring all localities to do a good job in cleaning up and standardizing the deposit in the field of engineering construction.
The circular requires that local departments in charge of housing, urban and rural construction and finance should formulate practical work plans and conscientiously organize their implementation. According to the principle of "one enterprise does not fall, one project does not fall", find out the bottom line and establish a ledger. Before August 15, focus on finding out the types of deposits that should be canceled in the region, and the items that are not returned in accordance with regulations or contracts in the retained deposits. For the cancellation of the deposit, the receiving unit shall refund it immediately and ensure that it is fully returned before the end of September. For the part of the retained deposit that has not been returned within the time limit and the excess collection, the receiving unit shall return it before the end of this year, and pay the construction enterprise liquidated damages for overdue return as agreed. If the time limit for the return of the retained deposit is not reached, effective measures shall be taken to ensure that the return is due and on time. Implement a bank guarantee system and improve relevant management methods. We will speed up the construction of a credit system in the field of engineering construction, increase the disclosure of credit information, promote joint incentives for trustworthiness and joint punishment for breach of trust, and establish a new mechanism to supervise and restrain construction enterprises.
The Ministry of Housing and Urban-Rural Development will organize an inspection team to conduct key inspections from October. Units that fail to implement the spirit of the documents and fail to rectify and reform, especially the competent departments of government investment projects and state-owned investment projects, will be notified to the relevant provincial people's governments. The competent departments of housing and urban rural construction in all localities should publish the telephone number and mailbox of complaints and reports to the public, and publish the typical cases of units that do not implement the spirit of the documents and the typical cases of collecting deposits in violation of regulations on the construction market supervision and integrity information release platform, and expose them through the news media.
