Notice on Further Standardizing the Construction Order of Electric Power Projects

All provinces, autonomous regions, municipalities directly under the Central Government, Xinjiang Production and Construction Corps Development and Reform Commission (Energy Bureau), various agencies of the National Energy Administration, State Grid Corporation, China Southern Power Grid Corporation, Huaneng, Datang, Huadian, Guodian, Guodian Investment Group, Shenhua Group, China Coal Group, SDIC, China Resources Group, China International Engineering Consulting Corporation, Electric Power Planning and Design Institute:
In order to implement the implementation plan for cleaning up and standardizing the approval items for construction of investment projects (Guofa [2016] No. 29, hereinafter referred to as the implementation plan) recently issued by the State Council, further clean up and standardize the construction approval work of approved power projects (this notice refers to thermal power and power grid projects, the same below), promote the streamlining of administration and decentralization, and effectively maintain the construction order of power projects, The relevant matters are hereby notified as follows:
1. clean up and standardize the items submitted for construction approval. The "Implementation Plan" cleans up and regulates the approval of investment projects established by relevant departments of the State Council. In order to implement it, all relevant units are now requested to support the clean-up and standardization of construction approval items for power projects. Those that do not meet the relevant requirements of the "Implementation Plan" will no longer be used as pre-conditions for construction.
2. clear signs for the commencement of power projects.Considering the actual construction of the project, the start mark of the thermal power project is clearly defined as: the first-party concrete is poured on the foundation cushion of the main power plant; the start marks of the variable engineering and line engineering in the power grid project are clearly defined as: the foundation excavation of the main project and the foundation excavation of the line. The development and reform commissions (energy bureaus) of all provinces (autonomous regions and municipalities) and the dispatched agencies of the National Energy Administration should use this as a judgment standard when carrying out relevant work.
3. effectively maintain the order of power construction.For the construction approval items and mandatory evaluation work that really need to be carried out, the power project units must implement them one by one and handle them in strict accordance with the procedures. It is strictly forbidden to start construction before the necessary supporting documents are obtained. If construction has already started, construction shall be stopped immediately.
4., coordinate and guide the construction of coal power.Development and reform, land, environmental protection, water conservancy and other departments shall combine the "Notice on Promoting the Orderly Development of my country's Coal Power" (Development and Reform Energy [2016] No. 565, hereinafter referred to as "Document 565") relevant requirements, as well as the regular coal power planning and construction risk warnings issued by the state, formulate targeted policies or take corresponding measures. The National Development and Reform Commission and the National Energy Administration will establish a coordination and linkage mechanism with relevant departments to effectively promote the orderly development of coal and electricity.
5. regulate the orderly construction of coal power.Local governments and power generation enterprises should attach great importance to the risk early warning tips for coal power planning and construction issued by the state on a regular basis. For provinces (autonomous regions and municipalities) with red warning results, they should carefully make decisions to start coal power projects. Conscientiously implement the relevant contents of document No. 565, and postpone the construction of coal power projects that have been approved but not started before the end of 2017.
6. strengthen the construction of special inspection.The development and reform commissions (energy bureaus) of all provinces (autonomous regions and municipalities) and the dispatched agencies of the National Energy Administration shall, in conjunction with relevant departments, increase the supervision and inspection of violations of power projects, especially thermal power projects that have not met the construction conditions. Once discovered, the Provincial Development and Reform Commission (Energy Bureau) must order it to stop construction immediately, and relevant departments must deal with it seriously in accordance with laws and regulations.
For thermal power projects under construction that have not obtained the necessary supporting documents to start construction, in addition to the implementation of the above measures, construction will be suspended until the end of 2017 for those provinces that are explicitly required to postpone construction in document 565. For other thermal power projects, construction can only be resumed after the necessary supporting documents have been obtained and verified by the corresponding provincial development and reform commission (energy bureau).
7. severely deal with construction violations.For power projects that start construction in violation of regulations, refuse to stop work, and do not accept the handling of relevant departments, the corresponding provincial (regional, municipal) development and reform commission (energy bureau) may implement restrictions on the project unit and its affiliated group companies. Measures such as new power projects, no consideration when carrying out the optimization of self-use and external coal power projects; the National Energy Administration will notify the country; banks and financial institutions shall stop granting loans to them in accordance with laws, regulations and relevant state regulations.
For thermal power projects constructed in violation of regulations, the National Energy Administration and its dispatched agencies will not apply for business licenses, and power grid companies will not be connected to the grid.
This Circular shall be implemented as of the date of issuance.
